摘要：2006年1月1日开始实施的新公司法对中小股东加大了保护力度,但是,对公司中两大基本要素之一的劳动者没有给予应有的关注,尤其对劳动权力更是只字未提①。劳动和资本是公司的两大基本关系,因此,充分重视劳动权力,提升劳动权力的地位,使劳动权力与资本权力在公司中处于对应的位置,是现代社会中公司生死存亡的生命线。正确树立企业劳动与资本调节机制所依据的基本理念,研究调节机制的路径选择是完善公司治理、构建和谐劳动关系的关键。
The new company law, which has already come into force on January 1st in 2006, causes people’s attention through protecting medium shareholders and small ones. However, it is regrettable that the new company law doesn’t pay enough concern to workers, which is one of the two essential elements in company, especially to the labor power.
