摘要：当前学界主要集中对城市社区协商民主的功能性实践和程序化过程展开具体的研究,而较少地将其概括化为一组抽象意义上行动要素构件的应用性架构来加以探讨。事实上,城市社区协商民主确然存在着一个基础的、通用的、相对独立的指向解决某一开放性问题的具有一定约束性和支撑性的行动框架。此一行动框架作为规范性与经验性相叠合的“行动化”概念性设计和行动表现形式在具体实践中需要治理能力与合法性的双重建构。在阐明城市社区协商民主行动框架基本要素的基础上,治理能力与合法性双重建构所生发的基本关系及其内蕴的正当性和行动化基本逻辑是其何以可能的前提和条件。围绕何以可为,以松散耦合与紧密耦合集成的混合型结构安排成为治理能力和合法性实现双重建构的操作化方式。
The current academic circles mainly focus on the concrete research on the functional practice and procedural process of urban community consultation democracy,but rarely generalize it as a set of application frameworks of action elements in an abstract sense. In fact,there is indeed a basic,universal,and relatively independent framework of action that is constrained and supportive for solving an open problem in urban community deliberative democracy. This action framework,as an “action-oriented”conceptual design and action manifestation that superimposes normative and empirical nature,requires a dual construction of governance capability and legitimacy in specific practice. On the basis of clarifying the basic elements of the urban community consultation democratic action framework,the basic relationship arising from the dual construction of governance capacity and legitimacy and its inherent legitimacy and basic logic of action are the prerequisites and conditions for its practicability. Focusing on what can be done,a hybrid structural arrangement integrating loose coupling and tight coupling has become an operational way to achieve the dual construction of governance capabilities and legitimacy.
