摘要：针对涉罪未成年人开展社会调查是《刑事诉讼法》的明确要求,然而目前在我国未成年人司法实践中,社会调查工作处于理论依据不明确,调查内容多元分散的状况。在涉罪未成年人社会调查过程中,应以社会学等相关学科研究成果为基础来确定社会调查的内容。本文以社会系统理论为框架,详细分析了涉罪未成年人社会调查应涵盖的具体内容。
According to the charges made against minors in Code of Criminal Procedure,carrying out social surveys is the clear requirements, but now in our juvenile justice practice, social work in theoretical investigation is not clear,and the survey content multivariate dispersion conditions. Crime involving minors in social investigation,sociology and other related disciplines should be based on research to determine the content of social surveys. In this paper,based on the theoretical framework of social systems,a detailed analysis of the specific content of the charges made against minors is covered by social survey.
