摘要：尽管目前我国企业对外投资势头强劲,却频频遭遇投资风险,海外投资企业亟待构筑"走出去"风险防控体系。用风险管理的方式管理法律风险对这些企业具有重要意义。论文在分析海外投资法律风险的特性后,探讨建立海外投资企业法律风险管理系统的必要性与可行性,提出构建以规避法律风险为核心的法律风险管理系统的总体思路、基本原则及系统架构。
Risk management approach also applies to the rapid developing Chinese overseas investment enterprises.It has an important significance for Chinese overseas investment enterprises, which need to build up the legal risk prevention and control system as soon as possible within a high risk period.This paper discusses the necessity and feasibility of establishing the legal risk management system for Chinese overseas investment enterprises after analyzing the features of the legal risks during overseas investment. It gives the basic principles and contents to build up the legal risk management system for Chinese overseas investment enterprises to avoid legal risks.
