摘要：国际贸易条约作为国家之间相互权利与义务的约定,关涉国家重大利益的安排,故其决策应科学化、民主化和法治化。但WTO协定、国际人权协定,以及我国既已签署的自由贸易协定中评估相关的中英文表述比较混乱,急需正本清源。国际贸易条约的评估可分为缔约前影响评估和缔约后履行评估,前者注重谈判结果的预测,旨在确立谈判策略;后者注重条约履行效果,旨在重启谈判,或协商修改条约。国际贸易条约的评估机制作为条约评估的“规律性模式”,主要包括触发、实施和回应等三个主要程序。
As an agreement on the mutual rights and obligations of countries,international trade agreements are arrangements related to the major interests of the state,so their decision-making should be scientific,democratic and rule-of-law.However,from the WTO agreements,international human rights agreements,and free trade agreements that China has signed,the relevant Chinese and English expressions are confused,and it is urgent to clear the source.The appraisal of national trade treaties can be divided into ex ante assessment and ex post evaluation,the former focusing on the prediction of negotiation results and aiming to establish a negotiation strategy;the latter focusing on the effect of implementation,aiming at restarting negotiations or modifying agreements.As the"regular model"of treaty appraisal,the appraisal mechanism of international trade treaties mainly includes three main procedures:triggering,implementing and responding.
