摘要：作者认为民间法研究对一些在建设中的国际大都市同样具有重要价值。本文以上海市浦东新区首创且普遍推行的“草根宪法”为例,深入考察了作为“草根宪法”实践创发地的上海市浦东新区合庆镇,分析了“草根宪法”的实践动力,及其对当地所带来的变化,并论证说明“草根宪法”作为民间法的特质及其功能。
We think that the folk law research also has an important value to some international metropolis in constructing.This paper take the"grassroots constitution"as an example,which is pioneered and generally implemented by Heqing town in Shanghai PuDong new area,and deeply analyzed the practice power and the changes brought to the local,and demonstrated the grassroots constitution as the character and function of folk law.
