摘要：文化财产问题长久以来就是国际社会关注的一个焦点。文化财产是根据其内容来界定的并首先在战争法中提出的概念。从古代到二战期间,文化财产受到了空前的破坏,有被盗、被抢也有被损毁。现存于海外的被盗和被抢的我国的文化财产不计其数,但是我们的追索之路却充满了障碍和坎坷。本文欲从国家责任的角度,探究国家违背保护文化财产国际公约的义务而产生的国家责任,希冀对我国文化财产的追索有所裨益。
Cultural property has long been a focus of the international community. It was first proposed in laws of war and was defined by its contents. From the ancient times to World War Ⅱ, cuhural property had been destroyed unprecedentedly, some stolen, some robbed and some completely destroyed. Currently, a large amount of our country＇s cultural properties are overseas since they were stolen or robbed. Though we maintain that our cultural properties should come back to our own country, the way of recourse is full of obstacles and difficulties. This article, from the perspective of state responsibility, will research the state responsibility which is raised by the state＇s breach of obligations under the international laws, which is expected to offer a theoretical basis different from the existing ones for the recourse of our cultural properties.
