摘要：自认规则是民事诉讼中的重要证据规则,由于长期以来我国没有关于自认规则专门的法律规定,因此,对自认尚未在理论上作过深入系统的研究。本文从介绍自认规则的一般理论着手,分析了我国现行司法解释关于自认的有关规定,探讨了自认规则的法哲学基础,提出现有法律规定中的不足之处,进而提出了立法完善的建议。
This article begins with introducing the general theory on the self-confessed rule, analyzing the existing judicial interpretation on it and questioning its basis on jurisprudence philosophy of law. It points out the lacking in our actual legal rules, and finally presents pieces of advice on how to perfect it .
