摘要：近代西方出现的全面、激烈、持久的刑法学派之争,推动了西方各国刑法近代化及现代化的进程。自1842年鸦片战争以后,近代西方刑法思潮开始传入我国,成为晚清以至民国时期刑事立法的精神支柱和理论基础,也推动了我国刑法的近代化进程。新中国成立之初,由于历史、政治等方面的原因,在彻底否定旧法的同时,对西方历史上的刑法学理论也全盘予以否定,从而,近代西方刑法学说对中国刑法的直接影响被切断。改革开放以后,西方刑法学说再次传入中国,并全面冲击和推动着中国当代刑法的发展。特别是1997年修订的新刑法,充分借鉴、吸收了西方刑事古典学派和近代学派的合理内核。随着时间的推移,近代西方刑法思潮对我国当代刑法及刑法学将产生愈来愈大的影响。
Emergence of the all-sides, intense, and longqasting dispute among different criminal law schools in modern West, promotes the modernization of criminal law in Western countries. Since the Opium War in 1842, the modern Western criminal law ideas had been brought into China. It had become the spirit and the theoretical basis of the pillars of criminal legislation during late Qing Dynasty and the Republic China period, and has promoted the modernization of Chinese criminal law process. As the result of historical, political and other reasons, the west theory of criminal law in the history was confirmed to be negative completely, the same time when the old law was thoroughly negated, after founding of PRC. Thus, the direct influence of modern Western criminal law doctrine on Chinese criminal law had been cut off. After reforms and opening up, the theory of modern Western criminal law was introduced into China again, and fully impacted and promoted the development of Chinese contemporary criminal law. In particular, the 1997 revised Criminal Law fully borrowed and absorbed the core idea of west criminal classical school and criminal school of modern times. Over time, the thought of modern Western criminal law would have a growing impact on Chinese contemporary criminal law and science of criminal law.
