摘要：上海自贸区建设需要行业协会参与市场治理和应对国际贸易新规则的挑战。行业协会实际运行存在的俱乐部化倾向和"会员逻辑"强化、大企业控制与精英治理、功能"缺位"与"越位"、政府职能转移和政府担忧等问题,制约了其功能和作用的发挥,须通过组建行业协会联合组织,形成体系化的行业组织结构;增强行业协会的代表性,规范内部治理机制;加快制定和完善行业协会法及相关法律、法规;加大政府对行业协会吸引人才的支持力度等措施消除障碍因素。
China （Shanghai） Pilot Free Trade Zone requires trade association to participate in the market governance and cope with the challenge of new rules of international trade. There are many practical functioning problems for trade association including club tendency and strengthening membership logic,corporate control and elite Governance, vacancy and offside in function ,the transformation of government functions and government concerns, which restrict its function and role.So it must take the corresponding measures to eliminate the obstacle factors.such as set up united organization to formate structure system, enhance the representativeness of trade association and regulate the internal governance mechanism, establishment and perfecting of trade association law and related laws and regulations, increase the support force of government to attract talent for the industry association.
