摘要：此次《档案法》修订草案的内容适应了新时代档案利用工作发展的需要,特别是在提供法律保障、衔接协调其他部门法、提供多种法律救济途径三个方面做出较为科学具体的制度设计。这些是应当值得肯定的。当然,不容否认的是,《档案法》修订草案在档案公布、权利救济方面等制度设计上仍有不足之处,存在着可能的法律漏洞风险及不符合立法目的等问题,需亟待加以完善。
The revised draft of Archives Law has adapted to the development of archives utilization in the new age. In particular, it provides a more scientific and specific system design in three aspects: providing legal protection, coordinating other departments' laws, and providing various ways of legal remedy. However, it is undeniable that the revised draft still has deficiencies in some system design such as the publication of archives and right remedy, leading to problems such as possible legal loopholes and inconformity to legal aim, which need to be improved.
