摘要：民间法的研究需要解决其文化基础问题,这是民间法研究的合理性之根据,必须明确对民间法文化基础进行思考的价值。传统儒学文化作为民间法文化基础,为其提供了有价值的思想。
The problem of culture base need to be resolved for the study of civil law, which is the foundation of its plausibility. This paper talked over the value of making reflections on the culture basis of civil law, accounted for reasons why traditional Confucianism is as the basis of civil law, and demonstrated the valuable ideas that traditional Confucianism provides to civil law.
