摘要：印度与中国同为发展中大国,人口规模与经济结构都极为相似,但两国在反倾销实践中的表现却差异显著。印度近来已超越欧美等发达国家,在国际上成为了发起反倾销调查最多的国家,而中国却是国际上遭受反倾销调查最多的受害国,同时中国也是印度反倾销调查的主要目标国。本文选取反倾销调查中的正常价值确定作为切入点,通过对中印反倾销制度中的正常价值确定规则进行比较,试图探究造成中印两国反倾销实践显著差异的制度原因,并指出,印度反倾销正常价值确定规则在许多具体方面比中国相关规定详细,从而对实践更具指导意义。我国要更好地保护本国产业,则应该学习印度的反倾销经验,并对产业机构进行调整,减少与印度在国际贸易中的竞争。
India and China are both major developing nations, and very similar in population size and economic structure, but there have been significant differences in anti -dumping practice between the two nations. This article compares the anti-dumping rules between India and China, especially by focusing on the rules for determining normal value to explore the systemic causes of the significant differences in anti - dumping practice between India and China. Furthermore,this article indicates that the rules for determining normal value in Indian anti -dumping law are more detailed and can provide more guidance for practice if compared with that in China’s anti-dumping law. To better protect Chinese industries, China should, on the one hand, learn from Indian anti-dumping experience, on the other hand, adjust the industrial structure to reduce competition with India in international trade.
