摘要：公众知情权与食品安全的关系是目前理论与实务中被忽视的问题。没有充分认识到"食品安全只有在阳光下运行,才能得以保障"这一命题的价值所在,是导致我国食品安全问题"顽疾"的重要原因。如何设计科学的法律制度来保障让食品安全在阳光下运行,食品安全知情权的性质分析是一个基础的理论问题。把握消费者知情权的法律性质必须回答两个层面的问题:一是消费者知情权究竟是一项主观公权利还是一项主观私权利?二是消费者知情权究竟是一项实体权利还是一项程序权利?只有对这两个方面的问题揭示清晰,才能合乎逻辑地找到消费者食品安全知情权实现的路径。
The relationship between the people＇ s fights to know and food safety is a neglected issue in theory and practice. It is not fully aware of the value of the proposition that ＂food safety can only be guaranteed in the sun＂, which is one of the important reasons of the generation of China＇ s food safety ＂ Ills＂. How to design a scientific legal system to ensure food safety running in the sun, and the nature of the fight of food safety to know is a fundamental theoretical problem. Grasping the legal nature of consumers＇ right to know, we must answer questions of two levels： Firstly, whether the consumers＇ right to know is a subjective public right or a subjective private right？ Secondly, whether the consumers＇ right to know is a substantive right or a procedural right？ Only by clarifying these two questions can we truly understand the legal nature of consumers＇ right to know, and find the path of realization of right logically. In order to make food safety run in the sun, China＇ s food labeling and food advertising and other related legal system supporting system should be improved. The food safety risk assessment system, food safety information disclosure system and procedures re- lated to consumers＇ involvement in food safety should be improved. Through the use of civil and ad- ministrative public interest action, ensure the realization of food safety fight to know of consumers.
