摘要：国家和社会的分野是权利定义的一个难以跨越的话语背景。权利除了国家属性之外还具有社会属性,而且权利的社会属性要深远于其国家属性。国家不能将社会的全部领域进行覆盖,更不能将社会自有的功能给予剥削和占领,社会不能成为国家的附庸。和谐社会包含四个方面的权利和谐。在和谐社会的建设中,我们既要关注、借鉴和吸收其它国家的权利发展模式,更要立足于本国国情,走出一条中国权利发展的和谐之路径。
The distinction of nation and society becomes an insurmountable discourse background for the definition of right.Right is of both national and social attributes,with the latter more meaningful than the former.The nation can not cover all the fields of society,and neither can it dispossess the natural functions of society—society should not become an appendage of a nation.Harmonious society includes four aspects of right harmony.During the construction of harmonious society,we should not only learn from the experiences of others,but also act in accordance with our own situation and pursue a harmonious Chinese way of right development.
