摘要：元宇宙本质上为内容创作产业。虚实交叉创作引发了诸多著作权治理争议,其解决核心在于衔接虚拟创作与传统著作权体系。从著作权治理体系的全链条出发,元宇宙空间内容产业治理应以创作者与管理者作为产业链发展的核心纽带。一是从创作者的角度,基于元宇宙空间虚拟数字产品的作品属性、作品归属等著作权基础理论之刚性要求,建立元宇宙数字著作权治理规则。二是从管理者的角度,在元宇宙数字著作权授权许可的特殊性、维权难度大等具体问题上展开,实现元宇宙创作与内容产业发展的衔接。三是从创作者和管理者的双重互动视角,实现元宇宙空间数字著作权治理的相互耦合、互相照应。最后,在规则与技术、技术与治理互动等层面,逐步有序建构起符合元宇宙内容产业发展实践需求的著作权治理机制。
Metauniverseis essentially a content creation industry.The intersection of virtual and real creation has caused many disputes on copyright governance,and the core of its solution lies in how to realize the connection between virtual creation and traditional copyright system.Starting from the whole chain of copyright governance system,the governance of metacosmic space content industry should take creators and managers as the core ties of industrial chain development.First,from the creator’s point of view,based on the rigid requirements of the basic theory of copyright,such as the property and ownership of works of virtual digital products in the meta-universe,improve the governance rules of digital copyright in the meta-universe.Second,from the manager’s point of view,it is carried out on specific issues such as the particularity of the licensing of digital copyright in Metauniverse and the difficulty of safeguarding rights,so as to realize the connection between the creation of Metauniverse and the development of content industry.Thirdly,from the perspective of the double interaction between creators and managers,we can realize the mutual coupling and mutual care of digital copyright governance in meta-space.Finally,at the level of interaction between rules and technology,technology and governance,the copyright governance mechanism that meets the practical needs of the development of metauniverse content industry is gradually and orderly constructed.
