摘要：[目的/意义]国内学者围绕数据跨境流动规则这一议题开展了大量研究,而围绕已有研究进展和未来研究方向的系统性分析略显不足。通过整理国内影响度较高的文献观点,为未来数据跨境流动规则研究提供思路。[方法/过程]以知网收录的国内文献为对象,借助Citspace和知网可视化分析功能,将国内研究划分为数据跨境流动规则主张类别划分、理论基础研究、规则文本比较、分行业场景监管研究、数据跨境合规治理建设几种研究类型。[结果/结论]围绕实践开展的应用型研究和具体行业产业规则的研究已逐渐起步。未来应以实践为导向,结合国内外案例开展研究,为数据跨境流动国内立法走向完善提供监管-合规的微观指引进路,为我国推进数据跨境流动国际合作提供宏观理论支持。
[Purpose/significance]Domestic scholars have conducted extensive research on the issue of cross-border data flow rules,but there is a lack of systematic analysis on existing research progress and future research directions.By sorting out the domestic literature views with high influence,this paper provides ideas for future research on cross-border data flow rules.[Method/process]This paper takes the domestic literature collected by CNKI as the object,and uses Citspace software and CNKI visualization analysis function to divide domestic research into several aspects:cross-border data flow rules’advocating classification division,theoretical foundation research,text comparison,research on industry scenario regulation,and construction of cross-border data compliance governance.[Result/conclusion]The applied research and specific industry rules based on practice are gradually starting.In the future,we should be guided by practice and conduct research based on domestic and foreign cases,providing micro guidance on regulatory-compliance for the improvement of domestic legislation on cross-border data flow,and macro theoretical support for promoting international cooperation on cross-border data flow in China.
