摘要：法律与文化的相互关系问题是法律社会学研究的重要内容。作者认为,一定法律所表现的文化人格,是一定国家内在文化的展现。法治的建设如果忽略一定国家文化内在因素的作用,采取简单的"拿来主义"的移植,它的一个直接后果就是造成整个国家文化系统的紊乱。因此,中国法治文化的建设必须关注中国传统文化问题。而其中研究传统儒学对中国法治文化构造的价值就具有特别的意义。论文考察了传统儒学人文主义思想特点,分析了传统儒学对法治文化意义的立论,深入探讨了传统儒学对法治文化价值的具体体现。
The problem of the relationship between law and culture is an important part of the legal-sociology research. The author thinks that the cultural personality of law is the performance of a state＇s internal culture. If we take simple attitude to deal with law transplantation and neglect the function of cultural element in the building process of the rule of law which will lead to the disorder of all cultural system. That all we should pay attention to the matter of Chinese traditional culture and the traditional Confucianism research has special value for the construction of the law culture. This paper analyses the humanism features of the traditional Confucianism and the value of the traditional Confucian^sm for the cultural construction, and at the same time discusses the special reflection of the value of traditional Confucianism for the cultural construction of the rule of law.
