摘要：政府数据授权运营的公私协作趋向凸显出借助民间力量弥补政府数据商业利用短板的制度逻辑。该趋向呈现出正负双向影响:一方面,数据资产化带来政府数据的数量扩张和授权直接收益,同时也构建起以数据安全为导向的多元治理机制。但另一方面,过度重视市场化效率则可能会损害政府数据利用的整体长远效益,如政府数据权属保护的失衡化、某些地方政府有偿收费的短视化,难以有效回应数据安全的现实挑战,面临政府数据财产权利的确定与分配难题。由此需要构建一种更优的公私协作机制,具体策略包括宏观和微观两个层面的内容,即依据“数据二十条”分析政府数据授权运营的公益性,并完善公私协作应用中的平衡机制与互动机制。
The trend of authorized operation of government data through public-private collaboration highlights the institutional logic of leveraging private forces to make up for the shortcomings in the commercial use of government data.This trend has both positive and negative impact.On the one hand,the data becoming assets leads to the expansion of government data and direct benefits from authorization,and also constructs a diversified governance mechanism guided by data security.On the other hand,overemphasis on market efficiency may harm the overall long-term benefits of government data utilization,such as imbalance in the protection of government data rights,shortsightedness in local government charges of data use,inability to effectively respond to real challenges of data security,and difficulties in determining and allocating property rights of government data.Therefore,it is necessary to construct a better public-private collaboration mechanism.The possible strategies include both macro and micro-level ones,that is,analyzing the public welfare of authorized operation of the government data based on the Twenty Articles on Data,and improving the balance and interaction mechanism during public-private collaboration.
