摘要：著作权和邻接权是著作权法中相互平行的权利,但著作权的保护力度和范围明显强于邻接权,故而在讨论某种新客体适用著作权法何种权利保护时,有先后之分。人工智能创作物著作权法保护的逻辑为:首先界定著作权法视角下人工智能创作物概念的范围;其次分析产生机理,明确在当前著作权法体系下无法获得著作权的保护;再次,探究并确定邻接权作为人工智能创作物保护的可行性;最后,在保护的具体路径设计上,应从权利名称、权利主体、权利客体、权利内容和保护期限等制度入手。
Copyright and neighboring rights are parallel in the Copyright Law,but the protection and scope of copyright protection is obviously stronger than the neighboring rights.Therefore,when discussing the protection of a new object in the copyright law,there are successive points.The logic of the protection of the artificial intelligence creation copyright law is:firstly define the scope of the concept of artificial intelligence creation from the perspective of copyright law;secondly,analyze the production mechanism,and clarify that the copyright protection cannot be obtained under the current copyright law system;again,explore and determine the neighboring rights As the feasibility of the protection of artificial intelligence creations;finally,the specific path of protection should be designed from the system of rights name,rights subject,rights object,rights content and protection period.
