摘要：亚太地区,特别是东亚国家之间至今仍存着不同情况的领土争端。日本与中国,俄罗斯以及韩国的领土争端基本上都是历史遗留问题,主要由战争改变的边界和西方列强以不平等条约侵占的领土所致。本文旨在从条约法效力的角度,比较这三对领土争端,探求日本对待领土争端中历史性条约的态度,从而获得对解决中日领土争端的一些启示。
In the Asia -Pacific region, especially between East Asian countries, there are still different territorial conflicts up to now. Territorial conflicts between Japan and China, Russia, South Korea＇s are basically historical issues. They are mainly because the war changed the boundary and Western countries invaded the territory by means of unequal treaties. This article aims to compare the three pairs of territorial conflicts by the treaty law effectiveness and explanation, analyzing Japanese attitude to deal with the historical treaty in the conflicts, so as to gain enlightenments in solving territorial conflicts between China and Japan.
