摘要：权利内在逻辑上交叉重叠,使得在义务不确定、权利边界模糊之处易发生权利冲突,集中表现为社会主体应有权利与国家政治权力的冲突、个人权利与社会利益的冲突。因此,要以不危及政治的有效性和合法性、不损害社会公正、不影响社会协调等导向确定权利边界,并将权利冲突控制并衡平在合法、合理、适当的边界内。
The fights inherent logic overlap, so that in the not afi＇irmatory obligation, right boundary ambiguity is easy to occur right conflict, which focused on the conflict between social rights and national political power, individual rights and social benefit. The arti- cle puts forward that right boundary should be dtetrmined not jeopardize the political validity and legality, not to harm the social jus- tice, not to affect the social coordination and that will control and balance the rights＇ conflicts in legal, reasonable, appropriate bound- ary.
