摘要："余杭中泰垃圾焚烧厂事件"的发生撕裂了法治评估与法治现实,令法治评估效度成为重要问题,引起人们关注。所谓法治评估的效度,即法治评估的有效性,包括内容效度和结果效度两个层面。通过对指标体系构建、评估信息收集、评估数据处理、评估报告结论等余杭法治指数报告核心内容的文本研究发现,余杭法治评估实践存在评估的效度上事实与宣传的背离。而这一情况是评估技术不完善、评估缺乏有效接纳等内外因共同作用下结果。
The validity of the legal practice evaluation becomes an important focus through the event of Yuhang Zhongtai waste incineration plant. The validity of legal practice evaluation includes the content va- lidity and the results validity. The research finds the deviation between the validity and expression in the legal practice evaluation in Yuhang by analysing the content of index system, information collection, date process and the conclusion of the report. The lack of effective acceptance system and other reasons lead to above problem.
