摘要：为长江专门立法被视为保护长江的重要一环,因为现行法无法满足长江生态环境保护的现实需要。从历史维度和现实考量出发,长江立法面临诸多利益冲突:经济发展与生态环境保护、中央利益和地方利益、不同的水资源利用用途、流域管理与区域管理、政治管制手段与市场机制。长江立法想要实现预期的良好保护效果,必须对这些利益冲突进行有效的协调。国家可借助长江流域水资源配额交易制度协调经济发展和环境保护之间的冲突,创设专门的生态环境补偿基金来满足中央和地方的不同需求冲突,选择合理的水资源分配模式来协调水资源使用冲突,鼓励各方积极参与长江管理进而实现善治。只有如此,长江立法才能有效实现生态环境保护的目标。
Legislating special law is an important way to protect Yangtze River,because current legislation is unable to meet the needs of ecological protection of the Yangtze River.In the context of historical dimension and practical considerations,laws of Yangtze River are facing with lots of interests conflict,such as economic development v.ecologicalprotection,central interests v.local interests,catchment management v.regional management,political control v.market mechanism.These conflict interests must be properly adjusted in order to obtain the desired protective effect on Yangtze River.Water quota trading system over Yangtze valley need be established to effectively coordinate the conflict between economic development and disordered environmental protection.Ecological environment compensation fund need be created to coordinate the conflict between central interests and local interests.Multi-governance over Yangtze valley may be tried to coordinate the conflict between catchment management and regional management.
