摘要：社会保障权是公民的一项基本权利,是公民相对于国家的一项的公权利,国家必须在尽可能的范围内予以保障。对国家而言,公民的社会保障权是国家的一项基本职责和义务；然而同时,按照权利义务相一致原理,公民的该项权利并非绝对,社会保障权的行使与其他权利不同,它只能在一定条件下按照法律规定的方式行使,并不得滥用。随着社会的发展和进步,社会保障不再是国家和社会的施舍或馈赠,而是国家的一种义务,必然需要制度和法律的保障。
The right of social security, as a fundamental right of citizen, is a public right to the state. The state should try its best to ensure this right. This citizen＇s right is a duty of the state. But according to the theory of jurisprudence, this right isn＇t absolute. Different from other rights, the right of social security only can be exercised in the way of law, and cannot be abused. Along with the development of society, social security is not a charity any more, but a duty of the state. In order to realizing the right of citizen or duty of the state, we must make laws and form system to ensure it.
