摘要：难民甄别制度直接影响到避难申请者能否获得一国的法律保护。合理地构建中国的难民甄别制度,不但是遵守国际难民公约义务的要求,也是保护中国境内难民合法权利的要求。应该在目前的国际法和国内法框架结构下,循序渐进地完善我国的难民甄别法律制度,根据我国的实际情况,确定难民甄别机关,合理确定其分工及权限。也应当注意承担国际义务,加强难民救助方面的国际合作。
The results of the refugee determination directly affect the basic rights of asylum seekers.The reasonable construction of China's refugee screening system must not only comply with the obligations of the International Refugee Convention,but also protect the legitimate rights of refugees in China.We shall improve the legal system of refugee screening in the current international lawand domestic lawframework.We shall also determine the refugee screening institution and the division of labor and rights according to the actual situation of China.We shall carry out our international obligations while strengthening international cooperation in the relief of refugees.
