摘要：社区治理中的多元主体之间构成了复杂的多重委托代理关系,业委会、居委会、物业等群体性组织的合法性来自业主权利的让渡与授予,本是公众民意和公信力的体现,但在城市社区治理实践中却存在着多重困境。以W小区为案例,梳理参与社区治理的多元主体的内在行动机理和机制的形成过程,发现由于信息的不对称、代理关系的权责不清、治理目标的偏移等原因,在治理实践过程中“委托—代理”机制未能充分发挥其预期功能。针对社区治理中“委托—代理”机制所暴露出来的问题,应该通过用法治化破解社区利益冲突的难题、重塑基层政府在社区治理中的角色定位以及为主体赋能以自治实现共治等破解方法,在形成内部聚合力的基础上开展多元主体间的互动合作,最终实现城市社区治理的良性互动。
The multiple subjects in community governance constitute a complex multiple principal-agent relationship.The legitimacy of group organizations such as owners committees,neighborhood committees and property management companies comes from the transfer and grant of owners rights,which is the embodiment of the public opinion and credibility,but there are multiple difficulties in the practice of urban community governance.Taking W community as a case,we sorted out the internal action mechanism and formation process of the multiple subjects involved in community governance,and found that due to the asymmetry of information,the rights and responsibilities of unclear agency relations,and the deviation of governance objectives,the“principal-agent”mechanism failed to give full play to its expected function in the process of governance practice.In view of the problems exposed by the“principal-agent”mechanism in community governance,the problem of community interest conflicts should be solved through legalization,reshaping the role of grassroots government in community governance and enabling the main body to achieve co-governance through self-governance.On the basis of the formation of internal cohesion,interaction cooperation among the multiple subjects should be carried out to achieve the benign interaction of urban community governance.
