摘要：[目的/意义]在中国由专利大国向专利强国转型的过程中,基于专利质量的现有研究成果寻求中国专利质量提升的途径,对于提高我国科技水平具有重要的战略意义。[方法/过程]通过对国内现有专利质量的研究文献进行归纳与评述,对专利质量的内涵与专利质量的评价标准进行综述,由此得出应从专利技术、法律审查和经济效益三个构成要素的角度对专利质量的概念进行界定,并依据此三个角度对专利质量进行定性评价。在这三个构成要素中,专利技术的进步性属于基础性要素,体现专利质量的本质要求。在此基础上,通过对研究文献中提升专利质量的政策和法律对策的梳理。[结果/结论]在制度设计上应以政策手段为主、法律手段为辅,对于进一步探究专利质量的激励对策、完善专利质量制度体系具有借鉴意义。
[Purpose/Significance]In the process of China's transition from a country with a large number of patents to a superpower in terms of patents,it is of great strategic significance to improve the quality of patents.[Method/Process]The paper studies the definition and evaluation criteria of patent quality by summarizing and commenting on the domestic research literature about patent quality.It is concluded that the concept and the evaluation system of patent quality should be determined from the perspectives of technology,legality and economic benefits.And the progressiveness of patent technology,the adoption of legal review and the economic benefits of patent application are the three elements of patent quality in definition.Among these elements,the progressiveness of patent technology is the basic one,which embodies the essential requirement of the patent quality.[Result/Conclusion]Based on the literature review on patent quality policies and legal systems analysis,the paper concludes that the patent system should be based on policy measures and be supplemented by legal measures,which is a good reference for further research.
