摘要：数据产权制度是保障数据流通安全的基础性规则,现有的数据保护法律规范多以事后救济的防御措施为主,无法有效应对数据流通共享所形成的新型经济利益关系。由于数据本身的特殊性以及牵涉多方主体利益,目前国内尚未明确数据产权立法。本文通过对国内外法律实践以及学术观点的思辨,对数据产权法律保护的路径选择问题展开讨论,在综合现有立法和可行性的基础上探求数据产权司法保护的理想模式,为数据安全流动提供政策建议。
The data property right system is the basic rule to guarantee the security of data circulation.The existing laws and regulations of data protection are mainly defensive measures of post relief,which can not effectively deal with the new economic interest relationship formed by data circulation and sharing.Due to the particularity of data itself and interests of multiple subjects,there is no clear legislation on data property right in China at present.This paper discusses the selection of legal protection mode of data property rights through speculating on domestic and foreign legal practices and academic viewpoints,and explores the ideal mode of judicial protection of data property rights based on synthesis of existing legislation and feasibility,so as to provide policy suggestions for the safe flow of data.
