摘要：欧洲理事会的经济和社会权利的集体申诉制度是任择的,自1998年建立以来富有成效地运转着。在这一申诉机制中,欧洲社会权利委员会处于核心地位,其审查程序公平、公正。欧洲理事会部长委员会对欧洲社会权利委员的报告的审议是程序性的,因其最后决议或建议对被申诉缔约国不具有法律约束力,导致效果的不均衡。申诉案件涉及的条款较为集中。这一制度是各缔约国经济和社会权利国内救济机制在国际法上的延伸,是国际人权理论和实践发展的结果,并将进一步推动经济和社会权利的国际救济机制的发展。
The system of collective complaints of social and economic rights established by European Council is an optional complaint system, which has been practiced successfully since its establishment in 1998. In the collective complaint system, the European Committee of Social Rights （ECSR） performs the central function, and observes justice and impartiality in the reviewing procedures. However, the review of ECST＇s reports by the Committee of Ministers of European Council is naturally procedural because the resolutions adopted and the recommendations addressed by Committee of Ministers of European Council have no legal binding force on the State Parties, consequently having unbalanced effects on them. The provisions applied to handle the complaints relatively focus on some articles. This system is an extension of the domestic remedial system of the economic and social rights in the States Parties, and is the result of the development of international human rights in theory and practice. It will reinforce the development of the international remedial systems of economic and social rights.
