摘要：在我国的安全生产中,危险化学品监管是一项十分重要的工作,然而当前危险化学品事故的一再发生,表明对危险化学品的监管存在着明显的失范现象,一是监管人员的权力失范,二是监管部门的职责失范。从制度层面分析,可以看出其根源不仅在于对行政权力的约束力不足,行政问责制一定程度的缺位,而且对监管者的监管体系也不够完善。为此,应当通过不断完善制度,更好地约束政府职能部门及其工作人员的行政权力,使其更好地担负危险化学品的监管工作,以推进社会经济的稳步、健康发展。
In China＇s safety work,the regulatory of hazardous chemicals is an important task. But the accidents of hazardous chemicals have been repeating these years. There are two obvious anomie phenomena in regulatory of hazardous chemicals,one is power anomie of the regulators,and another is duty anomie of the regulatory departments. The institutional sources are not only scarcity of administrative power and vacancy of administrative accountability system,but also imperfection of regulatory system to regulators. So,in order to promote the steady and healthy development of social economy,we should constrain the administrative power of the governmental department and their staff,who should take more responsibilities for hazardous chemicals regulatory.
