摘要：政党规制是指国家通过宪法和政党法来规范和约束政党与国家的关系(党国关系),这是一种外部规制而非内部规制。政党规制促使欧洲的政党与国家相互渗透融合,党国关系的规范程度即法治化趋势明显增强,这种变化具有四个方面的表征:一是欧洲宪法规制和政党法规制的普及化;二是政党法律规制党内民主,欧洲政党性质走向国家化,从社会组织转型为国家机构的一部分,即公用事业单位;三是政党法规制的首要领域——政党收入越发依赖国家财政补贴;四是政党法律规制政党恩赐行为,欧洲政党的政府性在不断增强。加强政党规制已经成为规范欧洲党国关系的基本制度路径。
Party regulation suggests the legal and external regulation of parties through national constitutions and specific party laws for them to abide by democratic principles.Party regulation leads to the intensification and interpenetration of the relationship between political parties and the state in post-war Europe,which could be identified from four different dimensions.First,it means party regulation has spreads all over the Europe.Second,parties are regulated not only in their external behavior and action,but the intraparty democracies also prescribed or even proscribed too.Parties are perceived as integral part of state and permanent institutional entity currently,i.e.,transforming from social associations to public utilities.Third,as the most important regulatory area,party income is more and more financially dependent on public subsides.Fourth,the governmentness of parties has become more and more strengthened through regulating party patronage.Party regulation has become one of fundamental systems to democracy.
