摘要：土地是一个国家最核心的资源,土地制度也是一个国家最核心的制度。对以耕种土地为主要生产活动的乡村地区来说,土地制度对其它相关制度有很强的决定作用。本文扬弃了将地权理解成狭义的产权,转从汉语的本义来理解地权之"权",认为地权包括了治权、身份权和产权三重属性。中国历史上的地权模式存在三种"权"依次凸显的历史演进,当前正在发生的是地权的产权化过程。进而从治权、身份权和产权之间的关系来理解当代中国地权的内在结构,并以此为框架分析中国地权模式的区域差异。其中也不可避免地探讨了地权模式与乡村治理的互动关系,认为不同的地权模式对于乡村治理形态会有相应的影响。
Land is one of the most central resources of a country,and land system is also one of the most central systems of a country.For the rural areas with the cultivation of land as the main production activities,land system has a determinant role in relation to other systems.This paper discarded the narrow sense of construing land right as the right to property,and delved into the original meaning of the Chinese word to understand the right of the"land right"as to include the triple attributes of the right to rule,the right to identity and property rights.There is a historical evolution of the three kinds of"rights"in China's historical land rights model.What is happening now is the process of property rights of land rights.Then we can understand the inherent structure of land ownership in contemporary China from the relationship between the right of government,identity and property,and use this as a framework to analyze the regional differences of land ownership in China.Among them,it is inevitable to discuss the interaction between land ownership pattern and rural governance,and lead to the conclusion that different land rights model for the rural governance will have a corresponding impact.
