摘要：法院构建的以指标为内容、数字为手段的法官绩效考评制度,本意是通过促进法官更好地审判以提高司法质量和实现司法正义。实际运行中,却出现了唯数字化的倾向,背离了制度设计的本意。学界已对制度运行的异化现象给予了反思和批判,但由于方法不对并没有能够充分解释异化的内在逻辑。从内在视角出发,本文认为法官绩效考评制度在设计和运行中弥漫着政法传统的特点,制度的意图与支配制度的文化之间的内在张力才是制度运行中出现异化的根本原因。实现司法正义的根本途径在于需要从政法传统思维中走出来并过渡到法治思维中。
The aim of the judges＇ performance evaluation is structured by court intents to improve the quality of justice. There are many discussions about the alienation of the trend of the deviation from the system aim in factual working, but these discussions cannot find the inner logic of the alienation for the reasons of wrong methods. This paper shows the politic and legal characteristics of the performance evaluation system from the inner view and finds the real reason of the alienation is the inner tension between the system aim and the culture of the system＇domination. It is necessary to come out from the traditional thinking of politics and law and set up the thinking of rule of law.
