摘要：德国行政诉讼功能模式的历史演变,以主观公权利救济为逻辑起点,走过了一段实现主观公权利救济与客观法秩序维护相统一的历程。德国行政诉讼的历史演变,一定程度上反映了世界行政诉讼发展的趋势,不仅为我国行政诉讼功能模式的科学定位提供了方法论,也为我国行政诉讼类型化提供了一条可能的路径,即构建以主观公权利救济与客观法秩序维护为路径,以原告诉讼请求为起点的,实现主观诉讼与客观诉讼相统一的行政诉讼类型化体系。
The historical evolution of the function modes of the administrative procedure in German, with the relief of subjective public right as the logic origin, has gone through a process of realizing the unity of the relief of subjective public right and the maintenance of objective law order. The historical evolution of adminis-trative procedure system in German reflects the development trend of administrative procedure in the world to a certain extent, which not only provides methodology for the scientific orientation of Chinese function modes of the administrative procedure, but also provides a feasible path for typology of Chinese administrative procedure. That is the typing system of administrative procedure which starts with plaintiff＇ s claim, realizing the unity of the relief of subjective public right and the maintenance of objective law order with the path of building the relief of subjective public right and the maintenance of objective law order.
