摘要：国际贸易协定的履行评估和国内立法、法律绩效评估等同属于“法律规范”的评估范畴,欧盟、韩国和美国等自由贸易协定的评估实践证明,国际贸易协定的履行评估具有其存在的必要性和可行性。国际贸易协定的履行评估之实施机制是在确立科学的评估标准和方法的基础上,由评估主体收集、分析评估对象之国际贸易协定相关信息,撰写评估报告等进行评估活动的规律性模式,是履行评估的核心。主要包括评估主体、对象、标准和方法等评估方案的确定,以及收集、分析评估所需信息、撰写评估报告等实施评估等两个阶段。建构国际贸易协定履行评估的实施机制符合新一轮对外开放的自由贸易区发展战略,但在确立评估标准、方法等具体实施机制的建构方面,须坚持我国在国际政治、经济合作中人类命运共同体的国际法治原则。
The evaluation of the implementation of international trade agreements and the evaluation of domestic legislation and legal performance belong to the evaluation of"legal norms",and the evaluation practice of free trade agreements such as the European Union,Korea and United States proves that the evaluation of the implementation of international trade agreements has its necessity and feasibility.The implementation mechanism of the evaluation of international trade agreements is based on the establishment of scientific evaluation standards and methods,and the evaluation subject collects and analyzes the relevant information of the international trade agreement of the evaluation object,writes the report,and other regular evaluation activities,which is the core of the performance evaluation.It mainly includes the determination of the evaluation plan,such as the evaluation subject,object,standard and method,and the collection and analysis of the information required for the evaluation,and the implementation of the evaluation such as writing the report.The construction of the enforcing mechanism for the evaluation of the implementation of international trade agreements is in line with the development strategy of the new round of opening up to the outside world,but in the construction of specific implementation mechanisms such as the establishment of evaluation standards and methods,it is necessary to adhere to the principle of international rule of law in China's international political and economic cooperation.
