摘要：推进治理现代化的目标为构建地方行业协会外部治理体系奠定了现实基础。我国是政府主导型的体制,在地方行业协会的内部治理与外部治理的关系上,外部治理的改善是"首选项"。本文以上海对地方行业协会外部制度环境渐进性的改革为实证研究对象,提出必须跳出"行政管制"的惯性思维,确立建立在"治理"基础上的、具有可发展性的新的外部制度架构。本文认为在地方行业协会的外部信任结构基础上,政府、消费者、其他社会组织、新闻媒体等在各自层面上制定规范制度,为地方行业协会的外部治理提供法律依据或友善环境,相互协调、相互补充,实现地方行业协会有效的外部治理,为地方行业协会创造"有弹性"的自主发展空间、推动地方行业协会内部治理结构的完善。
The goal of model governance provides the basis for local industry association to reconstruct its external governance system. In the local industry association, the improving of external governance is the first choice because of the government＇s leading system. The paper took the external system environment progressive reform of the local industry association in Shanghai as the study object. Government, consumers, other social organizations and media must regulate their system to coordinate and complement the external management law for local industry association. It will create ＂elastic space＂ for local industry association, which is good for the realization of effective external governance and the improvement of internal governance structure for local industry association.
