摘要：自人类生活有法律相伴随以来,追问法的合理性是人类文化生活的一项重要内容,这种思考与法的现代性问题相结合,使得法必须体现以人为本,张扬人文精神的时代内容。法的现代性讨论属于法的合理性追问的范畴,但在这种研究中,对法的合理性追问思考的品质、价值以及人文精神的价值在法的合理性追问中所体现的文化内容有必要形成理论的自觉。
Questioning the rationality of law is an important part of human life since Law has come into force. Combined with the modernity of law, questions of the rationality make it a necessary for law to embody the human orientation and to display humanistic concerns of times. The essay expatiates that the modernity of law belongs to the category of the rationality of law, with the necessity of forming the theoretical consciousness of the cultural embodiment of the value of humanism in questions of the rationality.
