摘要：通过分析上海市奉贤区宅基地活用案例发现,奉贤区改革将宅基地盘活与农村公共服务建设融合,宅基地盘活目标由提升土地利用转变为改善村民生活,丰富宅基地改革含义;宅基地居住功能转变为养老保障、公共服务功能,转换宅基地改革思维。由于缺乏宅基地"三权分置"作为依托,奉贤区宅基地改革无法摆脱公共服务规模狭窄、宅基地盘活数量有限和维持改革持续性艰难的困境,目前仅为尝试阶段。今后,需认定宅基地资格权并调查宅基地闲置情况,促进宅基地改革与宅基地"三权分置"衔接。
Through the case study of the revitalization of rural homesteads in Fengxian District of Shanghai City,it could be found that the activation of rural homesteads was combined with the construction of rural public service facilities and the goal of activation of rural homesteads was shifted to improving the lives of villagers not just being enhanced land utilization,thus enriching the connotation of rural homestead reform.In addition,the residential function of the rural homesteads was transformed to the function of care service and public service,which switched the thought of rural homestead reform.However,due to be short of support on the"Three Rights(ownership right,qualification right and use right)Separation"of rural homesteads,the reform of Fengxian District was only a short-term attempt that could not get out of the dilemma of narrow public service scale,limited number of activated homesteads and difficulty in maintaining the reform sustainability.In the future,Fengxian District should be properly identified the qualification right of rural homesteads and taken an inventory of the idle homesteads,so as to promote the engagement of local reform with the"Three Rights Separation"of rural homesteads.
