摘要：乡村集体产权能否保障农民利益?国内社会学产权理论大多持肯定态度。通过对安徽省桃园村股权纠纷事件的剖析发现,在地方政府的权力运作下,集体产权面临"政府化"的挑战,即集体产权越来越难以保障乡村利益。这意味着社会学产权理论必须重新审视其理论视角和出发点。在地方政府和城市资本的双重挤压下,集体产权能够模糊的空间已非常有限,集体产权只有逐渐走向明晰化才能保护农民利益。
Can the rural collective property rights protect the interests of farmers? Most of Chinese sociological theory of property rights reviews it favorably.Through the analysis of Taoyuan village' s ownership disputes in Anhui Province,the study found that under the operation of power in local government,collective property facing the challenge of the 'governmentalization' namely collective property rights is more and more difficult to ensure the interest of the country.This means that sociological theory of property rights must be reexamined from the perspective of the theory and the starting point.Under the double squeezing from the local government and urban capital,the collective property rights would been very limited in vague space,only gradually to clear collective property can protect the interests of farmers.
