摘要：稀有矿产资源战略储备立法研究具有重要的战略意义,本文从"价值"的视角对其展开研究。稀有矿产资源战略储备立法的价值首先是指向资源的可持续利用,然后是生态环境保护,最后归结到社会的可持续发展,通过立法的形式保障和规范稀有矿产资源战略储备为国家国防建设、经济建设和科技发展提供资源保证和法律保障;稀有矿产资源战略储备立法的两大核心价值目标是效率和公平,其中,坚持稀有矿产资源战略储备效率第一,以最低成本和最大效益实施储备,同时兼顾公平,注重代际公平、区际公平等,为提高储备效率提供最公平的制度体制;稀有矿产资源战略储备是国家资源安全战略的重要组成部分,稀有矿产资源战略储备立法的价值标准被定义为"三个有利于"的标准:有利于保障国防安全;有利于保障经济安全;有利于维护生态安全。
Value orientation of strategic reserve of rare mineral resources legislation incorporates the resource sustainable utilization, and the sustainable development of the society, and the protection of the ecological environment, which can provide the resource guarantee and legal guarantee to meet national defense construction of economy technology development through the legislation. Two core value goals of rare mineral resources strategic reserve legislation are efficiency and fairness. Efficiency is first. Fairness focuses on inter- generational equity, regional equity, which is to provide the fairest system to improve efficiency. Rare strategic mineral resources reserve legislation must be conducive to the protection of national security, economic security and ecological security.
