摘要：在当代中国的刑事司法中,被害人可以通过司法救济和国家补偿的途径来维护其合法权益,但由于种种原因使得其获得的保护和救济非常有限。本文通过对以往被害人救助实践的认真反思和对域外经验的借鉴,试着提出一种社会化救助的思路,旨在弥补以往做法的不足,同时也兼顾各种救济方法之间的协调。
In contemporary Chinese criminal justice, victim can maintain their lawful rights and interests by judicial relief and national compensation. But for various reasons, they can obtain limited protection and relief. This article put forward an idea of social relief by serious reflection on the past relief practice and reference on extraterritorial experience to make up for the inadequacy of previous practice, and attend to the coordination between various remedies.
