摘要：人本主义哲学在西方影响甚远,不仅在社会生活领域,也在法学领域。其对于当代中国刑事司法也产生了深刻的影响。但由于人本主义自身存在一些无法解决的弊端,因而我国的刑事司法应在深刻解析和认真反思的基础上吸收、借鉴人本主义思想,并真正有效地推进人权保障。
Humanism philosophy has profound influences on western world, not only in the social life, also in jurisprudent field. It has also profound influences on contemporary China criminal justice. But because of some irresolvable shortcomings by itself, our country＇s criminal justice should absorb and draw upon fruits of humanism on the basis of deep analysis and serious reflection, and truly as well as effectively promote the protection of human rights.
