摘要：法律社会学的研究在中国已经具有不小的影响力,不仅引发了有关中国法学流派的探讨以及智识层面的再思考,还在社会实践中展现出了强大活力。新中国成立70年来,毛泽东的实践观为法律社会学的社会实践奠定了重要理论基础。从理论发展上看,法律社会学进行了以马克思主义法学理论为核心的法哲学反思,也沟通了中西和本土资源论的思路分野。从实践发展上看,法律社会学关注民族习惯法、民间社会规范、部门法、法治实践与评估等研究领域。从兴起原因上看,法律社会学上下贯通的研究特点十分重要。当前,法律社会学的发展尚需进一步明确学科定位、把握和处理"理论与实证"的关系及"国家与民间社会"的关系。进入新时代,推进构建中国特色法律社会学要围绕解决我国社会主要矛盾、坚持以马克思主义为指导、坚持以人民为中心、坚持问题导向、坚持面向世界面向未来。
Reflections on the 7070 th Anniversary of the Founding of New Chinath:The studies of legalsociology have already had a great influence in China,which not only led to the discussion of Chinese legal schools and the rethinking of the intellectual,butdemonstrated strong vitality in social practice.In the 70 years since the founding of new China,Mao Ze-dong’s view of practice laid an important theoreticalfoundation for the social practice of legal sociology.From the perspective of theoretical development,legal sociology reflects on the philosophy of law with theMarxist theories of law as its core,and forms a way of thinking about the communication between Chinese,Western and local resources theory.In terms ofpractical development,it focuses on national customary law,civil society norms,departmental law,legal practice and evaluation.As to its rise,the researchboasts of its important feature of thorough integration.At present,the development of legal sociology requires further clarification of its disciplinary positioningas well as the comprehension and treatment of the relationship between"theory and practice"and that between"state and civil society".In the new era,topromote the construction of legal sociology with Chinese characteristics,we should focus on solving the major social contradictions in China,and adhere toMarxism as the guiding principle,people-centeredness,and problem-orientation,and face the world and the future.
