摘要：美国的《国家环境政策法案》和环境质量委员会的相关法规确立了环境影响评价制度,其评估对象不仅包括工程和项目,也包括行政规章等立法文件。欧盟的《影响评估指引》,对立法环境影响评估的指标、方法和模型做出了分析和界定。在现有的条件下,主要应将立法的环境影响评估制度作为我国立法评估制度的一个重要内容来研究和发展;在条件成熟时,可以考虑将行政机关提出的法律草案及其制定的行政法规和规章的环境影响评估纳入到行政机关主导的环境影响评价制度中。我国的立法环境影响评估制度可以借鉴和使用成本收益的经济分析方法。
The NEPA and regulation of CEQ establish EIA system in USA,its objects including not only engineering and project,but also legislation such as regulation. The index system, method and model are analyzed and established in Impact Assessment Guidelines of EU. Now, the evaluation system of environmental impact of legislation should be developed in the evaluation system of legislation and in future, the evaluation of administration regulation should be carried out in the system of EIA in China. The economic method of costs and benefits should be used for reference in the evaluation system of legislation of China.
