摘要：日本建设循环型社会以可持续发展为理想目标,作为日本建设循环型社会基本法的《循环基本法》,其中立法理念、基本规划和原则的确立有着深刻的国内外背景,是其解决环境与经济发展矛盾的经验教训的总结。本文试图通过对日本《循环基本法》的理念、规划与原则的考察和研究,从比较中借鉴,探索我国推行循环经济的立法模式,为正处于由理念倡导向政策试验示范及至全面推进的转折时期的我国循环经济立法提出一些建议。
In Japan, the construction of recycle society is the ideal of sustainable development. Recycle Basic Law is the basic law for Japanese government to construct recycle society. The establishment of its legislative ideas, fundamental planning and principles is the collection of the experiences from the contradictions between environmental protection and economic development, due to its special national and international circumstances. The authors try to analyze the ideas, planning and principles of Japanese Recycle Basic Law. Now, in China the construction of recycle economy is at the turn from model test to comprehensive improvement. From such a survey, the authors will explore the legislative model for Chinese recycle economy and provide some suggestions.
