摘要：日本行政相谈制度在日本的政治社会生活中发挥了极为重要的作用,它与评价监督制度以及苦情救济推进会议共同形成了日本独特的苦情救济体系。日本在建设和发展行政相谈制度的过程中,充分展现出了法制化的价值理念,主要包括日渐成熟的行政相谈法规体系、完整的组织架构与工作机制、明确的行政相谈委员工作职责、成为沟通政府和民众的纽带等方面。当前,我国应当借鉴日本行政相谈制度的法制化经验,通过完善法律法规体系、强化信访机构调查督办权、扩大社会参与等途径,不断推进我国信访制度的法制化建设。
Japan’s administrative talk system,together with Japan’s evaluation and inspection system as well as grievance relief promotion conference,forming a unique grievance relief system with Japanese characteristics,plays an extremely important role in Japan’s political and social life.In the process of its construction and development of the administrative talk system,Japan has fully demonstrated the value idea of legalization,mainly including an increasingly mature legal and regulatory system of administrative talk,a complete organizational structure and working mechanism and a definite responsibility of administrative talk committee,which has become a link between the government and the public.At present,China should use the legalized experience of Japan’s administrative talk system as reference and even promote the legalized construction of China’s petition system according to improving China’s law and regulation system,strengthening the right of investigation and supervision of petition agency,and expanding the social participation.
