摘要：传统儒学与法治理论并非是简单地相排斥,而是可以相融。这种相融不只是传统儒学对法治理论某种要素予以了强调,而且可以产生知识的增量,这种知识的增量反映的是中国文化在这个方面可能对世界或人类具有的独特贡献,是真正意义上的中国创造。
This study suggests that the traditional theory of Confucianism and the rule by law is,in fact not simply with exclusive,but can be blended. This blending on the traditional Confucianism to the rule by law theory has not only a factor to be stressed,and can produce incremental knowledge,which reflects China’s culture in this regard.The author of this paper explores the theory of justice from the rule by law in this area with the traditional Confucian thinking.
