摘要：死者近亲属“为了自身的合法、正当利益”,可以对死者的相关个人信息行使查阅、复制、更正、删除等人格权请求权。死者享有拟制的个人信息权益,其遭受妨害的,近亲属可以行使人格权请求权,但其并非死者个人信息权益的权利主体。《个人信息保护法》第49条是对死者个人信息权益保护的限制,主要体现为限缩权利范围、双重限制机制及人格权请求权的内部与外部限制。应建立“近亲属”的限缩解释规则,创设以“合法利益”为中心的人格权请求权行权标准,建构“死者的相关个人信息”认定与限制机制,力争实现近亲属、死者与第三人的利益衡平。
For their“lawful and legitimate interests,”the close relatives of a deceased person may exercise claim rights pertaining to the deceased’s personal information,such as the right to access,copy,correct,and delete such information.While the deceased is deemed to hold personal information rights and interests,which may be infringed,it is the close relatives-not the deceased themselves-who are entitled to exercise the corresponding claim rights.Article 49 of the Personal Information Protection Law imposes restrictions on the protection of a deceased person’s personal information rights,primarily reflected in the narrowing of the scope of rights,a dual restriction mechanism,and both internal and external limitations on the claim right to personality rights.It is necessary to establish a narrow interpretation rule for the term“close relatives,”create a standard for exercising the claim right centered on“legitimate interests,”and develop an identification and restriction mechanism for“the deceased’s relevant personal information,”with the aim of achieving a balance of interests among close relatives,the deceased,and third parties.
