摘要：In the prevailing judicial reform era, the clash of legal systems and legal cultures reveals the disparity between the east and the west, and prompts China to think over its own legal system perfection as well as to carry out bold plans of innovation. China should not be addicted in the tedious theoretical debate about whether to import it or not, but should focus on the functions of Plea Bargaining in the judicial actions, which can help to distribute the numerous cases, enhance the efficiency of litigations, protect the human rights of people, and subsequently China＇s legal system will be improved and perfected. Italy＇sopening and cautious spirits should be used for reference in China＇s Plea Bargaining system.
在进行司法改革的今天，东西法律制度、法律文化的碰撞，除了让中国明确差距以外，也敦促中国为制度的完善进行认真地思考与大胆地改革。就辩诉交易而言，中国应当跳出引进与否这一无聊的单纯争论，将目光聚集到如何发挥辩诉交易在司法活动中促进案件分流、提高诉讼效率、维护人权等方面的功用，进而实现法律制度的完善。在这点上，意大利所持的开放精神和谨慎态度值得中国借鉴。
